1. About these Terms

These Terms and Conditions ("Terms") govern your access to and use of all websites operated by Food Ladder (ABN 89 132 323 347), including any subdomain of foodladder.org and foodladdertech.org (collectively, the "Sites"). By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, please do not use the Sites.

Food Ladder is a registered Australian not-for-profit organisation with its principal address at PO Box 423, Manly NSW 1655.

2. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the most recent changes were made. Your continued use of the Sites after any changes constitutes your acceptance of the revised Terms.

3. Use of the Sites

You agree to use the Sites only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Sites in any way that violates any applicable Australian or international law or regulation;
  • Attempt to gain unauthorised access to any part of the Sites, server, or any connected database;
  • Introduce viruses, trojans, worms, or other harmful material;
  • Use automated tools (bots, scrapers, crawlers) to access the Sites without our prior written consent;
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Sites for commercial purposes without express permission;
  • Impersonate or attempt to impersonate Food Ladder, a Food Ladder employee, or any other person.

4. Intellectual Property

All content on the Sites—including text, graphics, logos, images, videos, software, and educational materials—is the property of Food Ladder or its licensors and is protected by Australian and international copyright, trademark, and intellectual property laws.

You may view and print content from the Sites for personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, requires our prior written consent.

5. User Submissions

Where you submit information through our forms (including enquiry forms, volunteer registrations, and mailing list sign-ups), you warrant that the information provided is accurate and that you have the right to submit it. We handle all personal information in accordance with our Privacy Policy.

6. Donations

Donations made through our Sites are processed by our third-party payment provider (Raisely). Donations of $2 or more are tax-deductible in Australia. Food Ladder does not store your credit card or payment details. All donation transactions are subject to the payment provider's own terms of service.

7. Third-Party Links

The Sites may contain links to third-party websites or services that are not owned or controlled by Food Ladder. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You access third-party links at your own risk.

8. Disclaimer of Warranties

The Sites and their content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by Australian law, Food Ladder disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Sites will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, Food Ladder and its directors, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Sites.

10. Indemnification

You agree to indemnify and hold harmless Food Ladder, its directors, officers, employees, and volunteers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the Sites.

11. Privacy

Your use of the Sites is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal from them.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
